In a Circular Letter New York State Insurance Superintendent Eric Dinallo stated that same sex couples who were married legally outside the State must be treated as married people for the purposes of NYS Insurance Law-this includes health insurance.  In other words, an health insurance company cannot deny health insurance or other coverage to gay spouses, who were legally married outside of New York, and if it does, the company will be subject to discipline by the Insurance Department.
